
- Payment
All payments are due to be paid to Heart Specialists Limited (“The Company”) at the time of consultation or treatment unless prior arrangements have been made. If an invoice remains unpaid for a period of 14 days then interest will be due and payable on any amount outstanding calculated at a rate of 2% per month, or part thereof, from the date of the invoice to the date of payment. Any account that has not be discharged in full after two months will be referred to the Company’s debt collection agency for recovery and a collection fee of 25% of the amount outstanding will be payable by you. This clause is intended to be for the benefit of, and enforceable by our debt collection agency under the Contracts Privity Act 1982.
- Collection Costs
You will pay all legal and debt collection costs that we may incur, including solicitor and own client costs incurred by the Company, in enforcing or attempting to enforce our rights under these terms of trade.
- Health Information Privacy Code 1994
All records that we hold relating to you are subject to the Health Information Privacy Code 1994 (“the Code”). Information will be used for care, treatment and billing purposes. The secure storage, access to and maintenance of the accuracy of such information will be in accordance with the Code. The Company may release information to any third party for the purpose of collecting outstanding payments which are owed to the Company.
- Records Management
We will keep your records for a ten year period after completion of your treatment. Your files will be archived and kept in storage for this period after which they will be destroyed unless you instruct us in writing to the contrary.
- Limitation on Liability
Heart Specialists limited relies on third parties to carry out blood and other specialist medical testing. In the event of the failure of those third parties to provide accurate and timely results and or information, Heart Specialists Limited shall not be liable for any expense, claims, actions, or demand howsoever described arising from such failure or delay.
- Amendments
We may at any time amend/revoke/replace these terms of engagement. If we do so we will provide written notice of the new terms of trade at our offices and such amended, new or replacement terms will take effect immediately. Any continued use of our services will constitute your acceptance of those terms.
- Applicable Law
The laws of New Zealand shall apply to these terms of trade.
